The Supreme Court added Loy Brunson's emergency lawsuit surrounding the 2020 presidential election to its docket this week, a case targeting 388 federal officials including Mike Pence, Joe Biden, and Kamala Harris.
The case Loy Arland Brunson v. Alma S. Adams doesn’t focus on the outcome of the election, but rather that officials ignored legitimate calls to investigate the election and possible interference, ultimately violating their oath to defend the Constitution. The case claims the 388 defendants invalidated themselves from holding public office.
The Supreme Court entered the case into the docket on Tuesday after an expedited emergency process.
“We bypassed the 10th Circuit Court of Appeals using the Rule 11 (national emergency rule) and the US Supreme Court accepted it. We are now waiting for the Solicitor General to respond,” wrote Raland Brunson in an update.
Loy’s brother, Raland Brunson, carried out a similar suit earlier this year, which was turned down by the Supreme Court for undisclosed reasons.
One approach different in the latest attempt is that there is no mention of reinstating former President Trump. The suit also doesn’t blatantly call for the removal, but instead proposes a question to the justices:
“The violation of the Oath of Office is serious…doesn’t this give the trial court power to remove individuals from office, including this Court?”
Now it will be up to the Supreme Court to either take up the case or reject hearing further details.
Raland Brunson is simultaneously suing three Supreme Court justices: Sonia Sotomayor, Elena Kagan, and Ketanji Brown Jackson. He argues that by refusing to hear his original lawsuit earlier this year, they aided and supported enemies of the U.S. government.
“They lawyered up, complied with the order and filed a motion asking the judge to not let my case go forward on grounds that they are just too important to be sued,” he wrote. “Bring it on baby!”
