The Biden administration is urging the Supreme Court to authorize federal agents to dismantle razor wire at the U.S.-Mexico border, escalating the ongoing dispute between the federal government and Texas regarding the president’s immigration policy.
As illegal crossings surge, reaching an all-time high of 302,000 in December, an appellate court last month compelled the Border Patrol to halt the removal of razor-wire fencing installed by Texas along its southern border. This week, the Justice Department filed an appeal with the Supreme Court, seeking to suspend the lower court’s ruling.
“Federal law unambiguously grants Border Patrol agents the authority, without a warrant, to access private land within 25 miles of the international border,” contends the appeal.
This clash is not the first instance of the federal government conflicting with the Lone Star State over the implementation of Joe Biden's contentious immigration agenda. In a prior incident, the administration had threatened to take legal action against Texas if it enacted a law permitting state and local law enforcement to apprehend individuals suspected of crossing the border unlawfully.
Governor Greg Abbott of Texas, who signed the measure into law, expressed his frustration, stating, “The Biden Admin. not only refuses to enforce current U.S. immigration laws, they now want to stop Texas from enforcing laws against illegal immigration.”
"I’ve never seen such hostility to the rule of law in America," he added.
Beyond the southern border crisis, the legal showdown between Biden and Abbott raises fundamental questions about the balance of power. As Ronald Reagan once articulated, it questions “whether we believe in our capacity for self-government or whether we abandon the American revolution and confess that a little intellectual elite in a far-distant capital can plan our lives for us better than we can plan them ourselves.”
