When our nation is governed by executive orders, each change in administration brings about an avalanche of new policies.
That's not going to change under a Biden administration. According to the Washington Post, Biden's transition team is planning a mountain of executive orders reversing many of Trump's most popular moves. Here's a short list:
- He will rejoin the Paris climate accords, forcing the American energy industry to continue the decline it saw under President Obama
- He will reverse President Trump’s withdrawal from the World Health Organization, further empowering the China-led organizations.
- He will repeal the ban on almost all travel from some Muslim-majority countries.
- He will reinstate the program allowing “dreamers,” who were brought to the United States illegally as children, to remain in the country.
- Along with these immediate executive orders, Biden plans to lean on state governors to impose mask mandates in their states. Like all federal mandates, the mask mandate will be required if the states want to continue receiving federal dollars.
Americans can reasonably disagree about the wisdom of any of these policies. But there's a larger issue at stake -- why have we given the executive branch the power to make these policies in the first place?
All five of the items listed above should require the approval of the peoples' representatives in Congress. Our country shouldn't be able to join an international "accord" without the peoples' approval. The White House shouldn't have the power to unilaterally join or withdraw from an international organization or control the flow of immigrants from any given country. The president shouldn't be able to ignore current immigration law or pressure state governors to do things their residents don't want.
In short, Biden's plans reveal once again that we need to limit the power of the executive branch of the federal government.
The White House will never limit its own power, which is why the people and the states must join together to call the first-ever Article V Convention of States.
A Convention of States has the power to propose constitutional amendments that limit the power and jurisdiction of the federal government as a whole -- including the White House. These amendments can end the practice of executive orders, reassert Congress' role in the lawmaking process, and ensure federal agencies don't bully state governments into submission using the threat of withholding federal dollars.
