Article 6. Section 2 of the U S Constitution says, “This constitution will be the supreme law of the land. So are the laws of the United States which are made that conform with it. Nothing in any state law or state constitution which is different may stand against them. Judges in every state will be bound by them.”
So who according to the Constitution has the power to make “laws of the United States?”
According to Article 1. Section 1 of the Constitution of the United States, “All of the lawmaking powers granted by this agreement will be entrusted to a Congress of the United States”.
How does this relate to the recent presidential executive order limiting and restricting Second Amendment rights?
According to the Second Amendment, “the people have the right to own and carry firearms, and it may not be violated because a well-equipped militia is necessary for a state to remain secure and free.” The Founding Fathers were not just talking about recreational hunting here.
Since Biblical times, the first thing rising tyrants do is remove the ability of the people they want to subjugate to defend themselves. The book of Judges, Chapters 4 & 5, tells of “Jabin king of Canaan who reigned in Hazor who harshly oppressed the children of Israel for 20 years.” And at that time “no not a shield or a spear was seen among 40,000 in Israel.”
“There is much discussion about the meaning of the term “militia” as it has evolved over the years. But at the time that the Constitution was drafted and ratified, nearly all able-bodied men in any state were considered to be part of that state's militia. They were expected to keep their own arms (weapons), and bring those weapons with them to fight when needed, as they had just done during the revolution.” (Biblical Citizenship Workbook)
So recent presidential executive orders restricting Second Amendment rights are highly unconstitutional for these two reasons:
First, they go against the Constitution, which is the supreme law of the land. Those laws supersede any presidential executive order especially when they do not conform with the Constitution.
Second, the president has no power to make laws. See Article 1 Section 1 of the Constitution, which again clearly states that laws shall be made only by Congress, “All of the lawmaking powers granted by this agreement will be entrusted to a Congress of the United States.”
The reality is each state has the constitutional right and the power to disregard and disobey these presidential executive orders. It is high time to rein in this gross overreach of the executive branch of the United States of America!
