THE CLAIM: ‘State Legislatures can’t control their delegates’ is FICTION AND FEAR

This baseless argument is another scare tactic to prevent well-meaning citizens from taking action to restrain the expanding federal government. The opposition relies on your unfamiliarity with basic legal principles and distracts you with misleading rhetoric to keep you from adequately educating yourself.

Black’s Law Dictionary, agency is defined as:  “A relation, created either by express or implied contract or by law, whereby one party (called the principal or constituent) delegates the transaction of some lawful business or the authority to do certain acts for him or in relation to his rights or property, with more or less discretionary power, to another person (called the agent, attorney, proxy, or delegate) who undertakes to manage the affair and render him an account thereof.”

Merriam-Webster defines Commission as “a formal written warrant granting the power to perform various acts or duties.”

The Constitution enumerates directly to state legislatures the power to apply to call an Article V convention of states for proposing amendments. 

Common practice in interstate conventions is for legislatures to issue written commissions to their delegates to negotiate on their behalf.

Any commissioner who violates those instructions is breaking the law!

The penalty for that transgression varies by state and can include recall, fines, or imprisonment. Indeed, the state legislature will declare any action a rogue delegate takes null and void.

The above-unfounded claim also contradicts another false assertion that the federal government will appoint and control the delegates and Article V convention.

Which is it, opposition? Both cannot be true.  

This contradiction is revealing and should be eye-opening. One side underestimates your intelligence, hoping you won’t investigate the details; in fact, they are counting on it. The other side encourages you to become self-governing, verify facts, and take no one’s word for granted.

Aren’t you insulted by the opposition’s arrogance?
