Erasure of Women’s Rights

A woman is defined as an adult female human.[1] President Joe Biden revised the Department of Education definition of sex under Title IX as the gender that the individual identifies as, or gender identity, which applies to all “public K-12 schools, as well as colleges, universities, and other institutions that receive federal funding [2]

This hurts women in many ways, as pointed out in an article by Heritage Action for America [3], not the least of which is women having grave disadvantages in women’s sports, which may also result in injury and/or loss of opportunities that can help them with their career.  A prominent outspoken example of this is Riley Gaines who competed and tied with a man named Lia Thomas.[4]

In compliance with the 14th amendment “Title IX specifically prohibits sex discrimination.” [5] However under the Biden administration, that’s exactly what it’s doing, discriminating against women, and erasing women’s rights.  The current mission of the U.S. Department of Education is to “promote student achievement and preparation for global competitiveness by fostering educational excellence and ensuring equal access.” [6] 

This Executive revision to the Department of Education does not comply with the spirit of the US Constitution, for the Legislative branch is supposed to write the laws and the Judicial Branch interprets them.  Some States like Texas, under the leadership of Governor Greg Abbott [7] are fighting back by not complying with the new Department of Education regulation that sex no longer matters but "gender identity" with regards to Title IX.

This fight could take years to play out in the courts. There’s no guarantee that non-compliance against an unconstitutional law would win in Court with the nine Supreme Court justices currently serving, as evidenced by Justice Ketanji Brown Jackson saying she cannot define what is a woman because she is not a biologist.[8] 

Is there a way for the people to push back against this gaslighting? The Biden administration is using the administrative state of the federal government to indoctrinate a generation to accept tyranny. On their road to complete control, the enemies of freedom never stop assaulting the minds of the free.

The framers of the Constitution, in 1787 [9], understood the problem of federal overreach.  That’s why they gave the states in Article V the power to stop tyrants.  By holding an Article V convention of states, power seized by the federal government can be returned to the people through amendments that limit the scope, power, and jurisdiction of the federal government.  Nineteen states have already agreed to meet for this purpose.  Find out here which states: Progress Map. It’s worth noting that buried deep in the Department of Education website it is written: “Please note that in the U.S., the federal role in education is limited. Because of the Tenth Amendment, most education policy is decided at the state and local levels.” [11] But exactly how limited is this role if it redefined the definitions of a man and woman to the point where it erases women?   Perhaps when the Article V convention of States convenes, the States could erase the Department of Education, which began operating on May 4, 1980.[12]
