More Executive Branch Overreach Makes a Solid Case for an Article V Convention

Published in Blog on September 14, 2021 by Mike Harper

The Executive Branch has instructed OSHA to mandate COVID vaccinations for all employees of companies with 100 or more workers.

Yes – OSHA! How did this happen, and who exactly believes it is within the constitutional powers of the Executive Branch to demand such a thing? The answer is certainly not President Biden, who recently said he did not believe he had the constitutional authority.

This is becoming a pattern, and neither the Courts nor Congress has yet to exercise their power of checks and balances to stop the repeated invocation of Executive “authority” which does not exist. The latest outrage comes on the heels of the direct snub of a Supreme Court ruling on the Eviction Moratorium Ban and the letters to local School Districts directing them to disregard State Laws.

Is the Administration just trying to buy some time? Maybe their goal is to accomplish more vaccinations and the masking of more children in schools before they are forced to retract the unconstitutional bureaucratic overreach. They do not even argue that these moves are legal – just that it will take a while for them to be ruled unconstitutional. As Biden’s own Chief of Staff re-tweeted: “the ultimate work-around.” Where will it end?

With an Article V Convention of States – that is where it will end – and it must!  While Congress is unwilling to assert its legislative power and the courts are unwilling or unable to enforce their own rulings, only the people, through their State Legislatures can effectively rein in the overreach. States can propose  Amendments through an Article V Convention to re-balance the skewed power of government and provide meaningful limitations to rein in their abuse.

Our current system is broken. We the People need to encourage our state legislators to call an Article V Convention.  It only takes 34 states to call a convention and we are nearly half way there. The process requires 38 states to ratify any proposed amendment. Now is the time. We the People are living in a Constitutional crisis.  Sign the petition and volunteer today!
