Kamala Harris would use the executive branch to "approve" state abortion laws

Published in Blog on May 30, 2019 by Article V Patriot

Our republic is under attack.

When the Founders wrote the Constitution, they imagined three branches of the federal government, each with their own responsibilities and powers. They also imagined a separation between state and federal power that gave the states relative autonomy and granted to the national government a narrow window of jurisdiction.

Both limitations on federal power would be thrown out the window with Democratic Senator Kamala Harris's new proposal.

Under her policy, states would be required to seek Department of Justice approval for laws restricting abortion to ensure that these laws "comport with the standards laid out by the Supreme Court in Roe v. Wade."

"States and localities will be subject to the pre-clearance requirement if they have a pattern of violating Roe v. Wade in the preceding 25 years," the campaign said, according to the Washington Free Beacon. "Under the plan, any change with respect to abortion in a covered jurisdiction will remain legally unenforceable until DOJ determines it comports with the standards laid out by the Supreme Court in Roe v. Wade … and the Women's Health Protection Act, which Harris co-sponsors in the Senate."

No matter which side of the abortion debate you're on, this is a clear violation of both federal separation of powers and the distinctions between state and federal power.

Harris's policy would empower the executive branch with judicial authority, granting the White House the discretion to determine the constitutionality of state law. It would also virtually eliminate the ability of state governments to pass abortion laws that comport with the will of the people in their states.

It is, in short, a terrifying example of federal overreach, and liberty-loving Americans from both sides of the political aisle should be cautious before granting federal executives this kind of power.

That's why millions of Americans (from both sides!) have joined the movement to call an Article V Convention of States. A Convention of States empowers the states and the people to propose constitutional amendments that reinforce the balance of power between D.C. and the states, and ensure that Washington stays in its proper place.

These amendments can limit the power and jurisdiction of the federal government, force Congress to be fiscally responsible, and mandate term limits for federal officials. Taken together, these amendments would restore the Founders' vision of a limited federal government and allow We the People to truly govern ourselves.

Petition your state legislator

Almost everyone knows that our federal government is on a dangerous course. The unsustainable debt combined with crushing regulations on states and businesses is a recipe for disaster.

What is less known is that the Founders gave state legislatures the power to act as a final check on abuses of power by Washington, DC. Article V of the U.S. Constitution authorizes the state legislatures to call a convention to proposing needed amendments to the Constitution. This process does not require the consent of the federal government in Washington DC.

I support Convention of States; a national movement to call a convention under Article V of the United States Constitution, restricted to proposing amendments that will impose fiscal restraints on the federal government, limit its power and jurisdiction, and impose term limits on its officials and members of Congress.

I want our state to be one of the necessary 34 states to pass a resolution calling for this kind of an Article V convention. You can find a copy of the model resolution and the Article V Pocket Guide (which explains the process and answers many questions) here: https://conventionofstates.com/handbook_pdf

I ask that you support Convention of States and consider becoming a co-sponsor. Please respond to my request by informing the national COS team of your position, or sending them any questions you may have:
