Democrats are looking for any excuse to pack the Supreme Court with four progressive justices, and they've found the perfect cover in Dobbs v. Jackson Women’s Health Organization.
The case, which the Supreme Court recently decided to consider, has the potential to overturn or significantly restrict the "right" to an abortion granted in Roe v. Wade. Pundits from both sides of the aisle agree that it's the biggest abortion case in a long time, and its ramifications could influence abortion law for generations.
Democrats are furious, and they're threatening to pack the court if the justices don't decide in their favor.
Sen. Richard Blumenthal (pictured above), for example, said the case will “inevitably fuel and drive an effort to expand the Supreme Court if this activist majority betrays fundamental constitutional principles."
"Chipping away at Roe v. Wade will precipitate a seismic movement to reform the Supreme Court. It may not be expanding the Supreme Court, it may be making changes to its jurisdiction, or requiring a certain numbers of votes to strike down certain past precedents," he continued.
He's not the only one. Sen. Sheldon Whitehouse (D-R.I) said of the case: “It really enlivens the concerns that we have about the extent to which right-wing billionaire money has influenced the makeup of the court and may even be pulling strings at the court.”
Brian Fallon, the executive director of Demand Justice, warned that expanding the Court was on the agenda:
“Groups like ours are doing work every day of the week, 52 weeks a year to build support for that proposal. … Part of our strategy here is to build support slowly but surely and grind out as much consensus around these ideas as we can for now and then be ready for if and when a big moment grabs the public attention comes. I think [the Supreme Court’s] next term is shaping up to be that.”
As Senator Tom Cotton recently pointed out on Twitter, the Democratic threat to destroy the judicial branch if they don't get their way is nothing short of blackmail.

Unfortunately, there is little Republican legislators can do to stop the court-packing efforts. Democrats have majorities in the House and Senate, along with the White House. If they unite in their desire to add justices to the Supreme Court, they can do it. If the few Democrats who oppose court-packing change their mind and cave to the pressure of their colleagues, conservatives can say goodbye to their majority gained by the election of President Trump.
But it's not only conservatives who should be worried. Packing the court would totally undermine its legitimacy and lead to constant fluctuations in the number of justices. No one will take SCOTUS decisions seriously if justices are added or subtracted for political purposes, which will send our nation one step closer to the brink.
We must stop the court-packing agenda before it's too late, and we can do it with a Convention of States.
An Article V Convention of States is called and controlled by the states and has the power to propose constitutional amendments that limit the power of the federal government. One of those amendments could simply prohibit Congress from changing the number of justices on the Supreme Court. Like presidential term limits or women's suffrage, such an amendment would be impossible to circumvent. The Court would be forever limited to nine justices, and the court packing debate would end once and for all.
