Kansas Senate Passes COS Resolution with Historic 29-11 Supermajority

On February 27 the Kansas Senate passed the COS resolution, SCR1604, with a historic 29-11 supermajority.  The vote on Thursday followed debate on Wednesday when opponents attempted to amend the resolution with absurd provisions that were ultimately ruled not germane to the resolution. It was a perfect demonstration of the way the convention will be able to reject proposals outside the three subjects of the convention.

On To The Kansas House of Representatives

SCR1604 now moves to the Kansas House of Representatives for action. The resolution is assigned to the House Committee for Federal & State Affairs for  recommendation to the full House where it will require a two-thirds supermajority of the 125 House members.  CONTACT YOUR REPRESENTATIVE HERE!

 

Opposition Making Wild Claims

Opponents of using the convention option of Article V, adopted without objection by the Philadelphia Convention, have been bombarding Kansas legislators with claims that Congress will control the convention; and that the convention can discard our Constitution and rewrite the entire constitution. You may have seen similar claims on social media. Here are some simple facts.

  • Congress cannot control the convention. The framers did not create a process to bypass the central government only to give Congress control over the convention.
  • Congress' authority in the convention process is limited to naming the initial time and place of the convention. Congress does not fund the convention or make the rules. The authority to make the rules is incidental to the express authority of the convention to propose amendments.
  • A convention called under Article V of the Constitution cannot discard the document from which it draws authority. This did not happen in 1787. Upon adjournment of the convention nothing was changed until all thirteen states approved a revised nine-state amendment process. Only then was the new Constitution ratified and replaced the Articles of Confederation. There never was a "runaway" convention.  
  • The Philadelphia Convention was not called by the Confederation Congress. It was called by the Virginia General Assembly using the recommendation of the Annapolis conference of 1786, "to devise such further provisions as shall appear to them necessary to render the Constitution of the federal government adequate to the exigencies of the Union."

 

Lawsuit Decision Not Yet Announced

A decision on the applicability of the Kansas Constitution to establish the number of votes required to pass a resolution defined by Article V of the US Constitution remains pending US District Court in Topeka.
