“How Does Gay Marriage Hurt You?” 


Congress has few and limited powers under Article I Section 8 of the Constitution, the section commonly called the “enumerated powers” of congress. This however has not stopped congress from accruing power that it doesn’t and shouldn’t possess with the help of complicit academia, media, courts, and the support of left-leaning voters.


The “Respect for Marriage Act” 

The Respect for Marriage Act (RMA) repeals and replaces provisions that define marriage as between a man and a woman and spouse as a person of the opposite sex, with provisions that recognize any marriage that is valid under state law. 

The RMA also repeals and replaces provisions that do not require states to recognize same-sex marriages from other states with provisions that prohibit states from denying privileges to out-of-state marriages on the basis of sex, race, ethnicity, or national origin. 

(The Supreme Court previously held that state laws barring same-sex marriages were unconstitutional in Obergefell v. Hodges in 2015)


“SEC. 6. NO IMPACT ON RELIGIOUS LIBERTY AND CONSCIENCE”

This section of the RMA states “(a) In General.—Nothing in this Act, or any amendment made by this Act, shall be construed to diminish or abrogate a religious liberty or conscience protection otherwise available to an individual or organization under the Constitution of the United States or Federal law.”

How can we know that this paragraph will accomplish its stated goal of protecting citizens’ religious and conscience rights? Just ask yourself if the words “shall not be infringed” in the 2nd Amendment have prevented infringements galore regarding the right to own and carry weapons for self-defense, and to defend our God-given rights against tyranny. 

Congress has no right to restrict our “free exercise” of religion per the 1st Amendment, but tell that to the campus Christian groups that have been shut down for not allowing LGBTQ individuals to join or even to serve in leadership roles.

Congress Has Found Things That Don’t Exist

Having “found” Social Security, welfare, Medicare & Medicaid, abortion, environmental protection, civil asset forfeiture, national parks, and a host of other things the Constitution doesn’t allow, congress now discovers that “gay marriage” is somewhere in there too, and the religious liberty paragraph will likely be twisted and bent to advance the very things it claims to be uninterested in doing. 


Brave New Words

The “Respect for Marriage Act” (RMA) amends the “Defense of Marriage Act” of 2013, which banned federal recognition of same-sex marriage by limiting the definition of marriage to the union of one man and one woman, and allowed states to refuse to recognize same-sex marriages granted under the laws of other states. 

So the Supreme Court batted away the Defense of Marriage Act’s protections. One need not have a vivid imagination to envision SCOTUS striking down the whole religious liberty section of the RMA on the basis that no one has the right to hurt “married” homosexuals’ feelings.

After all, the Bill of Rights is barely even considered to have any force or effect by congress and the courts, why should we expect one section of this RMA bill to be treated as if it were written in stone?

You will search in vain for any hint of congress’s authority over marriage in Art. 1 Sec. 8, but the mere absence of authority to pass a specific law has never stopped congress from trampling on rights it should fear to tread on.
