The feds have stolen state 'police powers'

Published in Blog on January 26, 2023 by HAL STANTON

As even a casual understanding of the United States Constitution illustrates, the first four articles define the powers and limitations granted to the four pillars of our governing bodies: Article I the Legislature, II the Executive, III the Judicial, and IV the Individual States.

In the 234 years since our Constitution was ratified the powers granted to each pillar have undergone numerous shifts. WE THE PEOPLE are very much aware of the fact that the first three pillars have ganged up on the fourth. The original document specified 17 precise powers to the federal government and as stated in the Tenth Amendment, all that is not enumerated therein is under the control of the states.

Many people have forgotten the 13 original states were functioning for an extended time before any thought regarding central governing came along. The fact of the matter is the states formed the central federal government and NOT the reverse combination.

In the beginning, the states governing practices were referred to as "police powers," meaning all matters associated with public safety, public health, public education, and public welfare were to be managed by the individual states. This may explain why the federal Department of Health, Education, and Welfare (HEW) is no longer in existence. In its place, we have the following: Dept. of Health and Human Services, Centers for Disease Control and Prevention, Food and Drug Administration, Dept. of Education, Dept. of Agriculture, and the Dept. of Energy.

There is no federal Department of Welfare but everyone knows the federal government is very heavily involved with welfare programs throughout numerous agencies.

The Tenth Amendment reiterates this idea: “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the People.”

Of all of the oversized federal agencies, perhaps the biggest offender is the Dept. of Education, which totally controls ALL education within our nation.

We are reminded every day of the week about the heavy influence exerted by teachers' unions. Just recently the DOE initiated an investigation against a Texas school district for banning LBGT books inside their school libraries. Another fine example of the fed's attempt to control all aspects of our God-given liberties.

Convention of States is here to stop these blatantly unconstitutional abuses perpetrated by the federal government. Join the movement to restore self-governance to the states.
